This policy says what you may not do with Ben AI. It is part of the Terms of Service. Ben AI can act in the world on your behalf, so these rules matter more than with a chatbot: you are responsible for what it does at your direction. We may pause, limit or end the Service for a breach, and we report illegal activity where the law requires or allows it.
1. Follow the law
Use Ben AI only for lawful purposes and in compliance with every law that applies to you, your industry and the people you deal with. You are responsible for knowing which laws apply to your use; we do not decide that for you.
2. Be honest
You must not use the Service to:
- impersonate a person, business, brand or government body, or claim an endorsement you do not have;
- deceive, defraud, scam or manipulate anyone, or run phishing, pyramid, get-rich-quick or similar schemes;
- write or post fake reviews, testimonials, engagement or social proof, or make advertising claims you cannot substantiate;
- present AI-generated communications as coming from a person, or let someone believe they are talking with a human, where the law, a platform or fair dealing requires disclosure;
- spread content you know to be false about public matters, elections, health or safety.
3. Respect people's privacy and consent
You must not use the Service to:
- send marketing email, texts, calls or messages to people who have not given the consent the law requires, or ignore opt-outs and suppression lists;
- collect, scrape, buy or combine personal data about people without a lawful basis, or track, profile, locate or monitor individuals without their knowledge and consent;
- process health, financial, biometric, children's or other sensitive personal data unless you are legally allowed to and have told us where our terms require;
- identify people from images or recordings, or use someone's name, face, voice or likeness without permission.
4. No harmful or high-risk uses
You must not use the Service to:
- create, obtain or spread content that is illegal, that sexualizes minors, that incites or threatens violence, or that harasses, bullies, defames or discriminates against people;
- develop or use weapons, malware, exploits or tools to attack, disrupt or gain unauthorized access to systems, networks or accounts;
- make or automate decisions that have legal or similarly significant effects on people (credit, lending, insurance, housing, employment, education, benefits, medical care, immigration, criminal justice) without a qualified person reviewing and able to change each decision;
- give medical, legal, financial or other regulated professional advice to third parties as if from a professional, or in place of one;
- operate critical infrastructure, medical devices, vehicles, or anything where an error could injure someone.
5. Respect brands, copyright and other rights
Only give Ben AI material you own or are licensed to use, and only publish output that does not infringe anyone's copyright, trademark, trade secret, publicity or other rights. Review names, logos, images, quotes and claims before anything goes public. Testimonials and results must be real and representative. You are responsible for advertising, consumer-protection and industry rules that apply to what you publish.
6. Use only accounts and sites you are allowed to use
When connecting apps or directing browser and computer use, you must not:
- give the Service credentials, keys, cards or accounts you are not authorized to use for that purpose, or share credentials that an app's terms say may not be shared;
- direct the Service to bypass sign-ins, CAPTCHAs, bot detection, multi-factor authentication, paywalls, rate limits or any access control, or to act against a site's or app's terms of use;
- use the Service for credential stuffing, scraping that a site prohibits, ticket or inventory hoarding, or creating accounts in bulk;
- direct the Service to make financial trades, move money, or buy, sell or transfer securities or cryptocurrency.
7. Do not abuse the Service
You must not:
- try to extract the Service's prompts, skills, models or source code, reverse engineer it, or probe or test its security without our written permission;
- use output to train, fine-tune or benchmark a competing AI product, or resell, sublicense or offer the Service to others as your own;
- try to get around usage limits, credit accounting, safety filters, approvals or other controls, including through prompt injection, or place injection attacks on pages or documents to redirect anyone's AI system;
- send malware, overload the Service, or interfere with other customers' use of it.
8. Money and payments
Pages that take payments run on your own payment processor account; you are the merchant and must follow that processor's rules and restricted-business lists. You must not use the Service for gambling, payday or predatory lending, multi-level marketing, unlicensed money transmission, cryptocurrency offerings, or any business your processor prohibits. Ben AI does not hold, move or invest money.
9. What happens if this policy is broken
Depending on how serious it is, we may warn you, pause the work involved, suspend part or all of the Service, or end your plan without a refund. Where there is risk of harm to people or to other customers, we act first and tell you afterwards. We may also remove content, refuse tasks, and report activity to authorities, platforms or affected parties where the law requires or allows. We update this policy from time to time; the version and date are at the top.
